WEFEW.NET’S USER AGREEMENT

INTRODUCTION

www.wefew.net (hereinafter referred to as “wefew.net”) is operated and owned by Cherry Collective Online Pte. Ltd. (Company Registration No. 200614266N). If you visit, shop or sell at wefew.net, you are deemed to have read and unconditionally accepted all of the terms and conditions in this User Agreement and agree to be bound by the following terms and conditions described within this User Agreement (“Terms of Use”). No additional action by you is required to bind you to this User Agreement.

A. GENERAL TERMS AND CONDITIONS OF USE (APPLICABLE TO ALL USERS)

BY USING THIS SITE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT :

  1. You must be 18 years and older to use this site. If you are less than 18 years old, you may use this site only with involvement of a parent or legal guardian;
  2. You are responsible for any activity that occurs under your screen name.

    3. ABUSING USE OF SITE

  3. You must not use wefew.net for any illegal, unauthorized or immoral purpose. All users shall comply with international and local laws. Where there is a conflict in the interpretation of international and local laws in the use and interpretation of this User Agreement, the choice of applicable laws shall be at the sole discretion of wefew.net.
  4. Any interference or attempted interference with wefew.net's site and/or operations using any software program, routine or activity is a serious offense and is not permitted. In no case may a user block, obscure, overwrite or modify in any manner any wefew.net’s generated content or pages. All other site locations or components of wefew.net are strictly for wefew.net’s use.
  5. You must not create or send any unsolicited emails (“Spams”) to any other user of wefew.net. Spam is not permitted on wefew.net. Spam is email that is both unsolicited and commercial in nature. Unsolicited email includes an email that has been sent without the invitation, request or the permission of the person who received it. Commercial emails includes any email that discusses buying, selling or trading of goods or services that has been sent without the invitation, request or the permission of the person who received it.
  6. You must not transmit any virus, worms or any codes of a destructive nature.
  7. You must not abuse, harass, threaten or in any other manner intimidate any other user of wefew.net. All threats of physical harm via any method including, phone, email and on our public message boards are prohibited.
  8. Falsifying or omitting contact information such as your name, address, and/or telephone number when registering on wefew.net is not permitted. It is also not permitted to use fax or disconnected numbers as a telephone number.
  9. Offers to buy or sell items listed on wefew.net (“listed item”) outside of the wefew.net are not permitted. Offers of this nature are a potential fraud risk for both Buyers and Sellers and circumvent wefew.net’s fees.

    10. LIMITATION OF LIABILITY

  10. Your use of the services at wefew.net is at your sole risk. The services on wefew.net is provided on an "as is" and "as available" basis. wefew.net expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
  11. wefew.net makes no warranty that (i) the service at wefew.net will meet your requirements, (ii) the service at wefew.net will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service at wefew.net will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service at wefew.net will meet your expectations, and (v) any errors in the software used at wefew.net will be corrected.
  12. Any material downloaded or otherwise obtained through the use of the service on wefew.net is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

    13. INTEGRITY OF INFORMATION POSTED

  13. You understand that all information, data, text or other materials on wefew.net ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not wefew.net, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. wefew.net does not control the Content posted via the service at wefew.net and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will wefew.net be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the service at wefew.net.
  14. You agree to indemnify and hold wefew.net, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the services at wefew.net, your use of the service at wefew.net, your connection to wefew.net, your violation of the terms of this User Agreement, or your violation of any rights of another.
  15. Neither wefew.net nor its affiliated or related entities or its business partners or content providers are responsible or liable to any person or entity whatsoever for any direct or indirect loss, damage (whether actual, consequential, punitive, special or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from (a) any information or opinions provided on wefew.net’s site or from the use of, or the inability to use any materials on wefew.net, or (b) any defamatory, offensive or illegal conduct of any user, or for any illegal tampering with the site wefew.net, hacker activity, computer crime, or theft of your personal information. If you are dissatisfied with the wefew.net site or any materials on the site, or with any of the other service providers including but not limited to the Sellers, or with the terms and conditions of this User Agreement, your sole and exclusive remedy is to discontinue using the wefew.net site.

    16. INTELLECTUAL PROPERTY RIGHTS

  16. All materials on wefew.net, including all images and illustrations are protected by copyrights which are owned either by wefew.net or an affiliated entity, or by third parties or other users who have either expressly or impliedly licensed their material to wefew.net for use on wefew.net. All materials on wefew.net, regardless or form or content, may not be copied, downloaded, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modification of the said materials or use of the said materials in any form or manner or for any purpose is a violation of the copyrights and other property rights held by wefew.net or affiliated companies, or by third parties or other users who have either expressly or impliedly licensed their material to wefew.net for use on wefew.net.

    17. USER AGREEMENT TO CONSTITUTE ENTIRE AGREEMENT

  17. This User Agreement constitutes the entire agreement between you and wefew.net and governs your use of the service provided by wefew.net, superceding any prior agreements between you and wefew.net (if any). You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. The User Agreement and the relationship between you and wefew.net shall be governed by the laws of the Republic of Singapore without regard to its conflict of law provisions. You and wefew.net agree to submit to the personal and non-exclusive jurisdiction of the courts located in Singapore or the choice of jurisdiction at the sole discretion of wefew.net.

    18. NON WAIVER OF RIGHTS

  18. The failure of wefew.net to exercise or enforce any right or provision of the User Agreement against any user shall not constitute a waiver of such right or provision. If any provision of the User Agreement is found by a court of competent jurisdiction to be invalid or illegal, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the User Agreement shall remain in full force and effect. You agree that regardless of any limitation laws or statute in any jurisdiction to the contrary, any claim or cause of action arising out of or related to use of the services of wefew.net or the User Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

    19. MODIFICATION OF SERVICES

  19. This User Agreement may be modified by wefew.net at any time without notice to you, at the sole discretion of wefew.net. wefew.net reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) at wefew.net with or without notice. You agree that wefew.net shall not be liable to you or to any third party for any modification, suspension or discontinuance of any of or the entire services at wefew.net.

    20. TERMINATION OF ACCOUNT

  20. You agree that wefew.net in its sole discretion and without limiting other remedies, may terminate your password, account (or any part thereof) or use of any of the services on wefew.net, and remove and discard any Content within wefew.net, for any reason, including, without limitation, for lack of use or if wefew.net believes that you have violated or acted inconsistently with the terms of this User Agreement.

    21. TERMINATION OF SERVICES

  21. wefew.net may also in its sole discretion and at any time discontinue providing any of the services on wefew.net, or any part thereof, with or without notice. You agree that any termination of your access to the services on wefew.net under any provision of this User Agreement may be effected without prior notice, and acknowledge and agree that wefew.net may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or such services. Further, you agree that wefew.net shall not be liable to you or any third-party for any termination of your access to the services on wefew.net.

DISCLAIMERS

  1. wefew.net makes no representation or warranty of any kind, whether express or implied, including, without limitation, the implied warranty of merchantability or fitness for a particular purpose, the accuracy, value or other elements relating to the works of art and design and information found on or linked to by wefew.net. wefew.net disclaims all such warranties to the fullest extent permissible under applicable law.
  2. wefew.net takes no responsibility and gives no guarantees, warranties or representations, implied or otherwise, for the accuracy, value or other elements relating to the works of art and design and information found on or linked to by wefew.net.
  3. Sites linked to from our website wefew.net may be created by people over whom wefew.net has no control. wefew.net cannot guarantee that sites found through wefew.net will not contain objectionable content and assume no responsibility for the content of any site included in any search results or otherwise linked to by wefew.net.
  4. wefew.net reserves the right, but has no obligation, to monitor activity on wefew.net including the investigation of any violation or purported violation of its rules. During and subsequent to such investigation, wefew.net may in its sole and absolute discretion, take any action as it deems necessary, without prejudice to all its rights to claim against any user who is in violation of any of the terms of this User Agreement for all damage or losses sustained as a result of such violation of its rules, to compel compliance with its rules and any governing law, including restricting, limiting or denying your access to wefew.net, causing the editing or removal of a product page, or issuing a written warning of a rules violation and requiring that such violation be timely corrected. Some examples of rules violations shall include but is not limited to the following:
    1. (a) Referring visitors to another web site to purchase listed items
    2. (b) Posting products that are unrelated to the arts industry
    3. (c) Posting material that is deemed as objectionable content
    4. (d) Rude communication with other users of wefew.net or wefew.net’s staff.
  5. To the full extent permissible by applicable law, wefew.net disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. wefew.net does not warrant that wefew.net, its servers, or e-mail sent from wefew.net are free of viruses or other harmful components. Wefew.net. shall not be required to prove that it had taken all necessary precautions to ensure that that wefew.net, its servers, or e-mail sent from wefew.net are free of viruses or other harmful components. wefew.net will not be liable for any damages of any kind whatsoever arising from the use of wefew.net, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
  6. Feedback
    You may not take any actions that may undermine the integrity of the feedback system. We may limit the number of purchases and listings you may place on wefew.net based upon the level of your feedback and the feedback from Buyers or other users of wefew.net. If 15% or more of your feedback scores are negative membership may be suspended and you may be unable to sell, or your use of wefew.net terminated.

B. ADDITIONAL SPECIAL TERMS AND CONDITIONS OF USE (APPLICABLE TO BUYERS)

BUYERS

  1. “Buyer” or “Buyers” refer to any user of wefew.net who uses or used the “Buy It Now” feature on wefew.net.

    2. HOW TO USE SERVICE

  2. All Buyers are required to register and log-in at wefew.net to use the services on wefew.net. You will define or receive a password and account designation upon completing wefew.net's registration process (“the Service”). You are responsible for maintaining the confidentiality of the password and account and for restricting access to your computer. You agree to be fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify wefew.net of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. wefew.net cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

    3. BUYER’S OBLIGATIONS

  3. In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or wefew.net has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, wefew.net has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
  4. All Buyers automatically enter into a legally binding contract to purchase the item from the Seller once they use the “Buy It Now” feature. wefew.net requires you to pay the Sellers for the items that you commit to purchase. Any failure to pay for items purchased shall remain a debt due and payable to the Seller.
  5. You shall not interfere with another Buyer or Seller’s transaction.
  6. You may not contact any Seller directly outside of wefew.net and offer to purchase a listed item outside of wefew.net. wefew.net shall be entitled to charge you a commission of 15% of the sale price of any item purchased from a Seller listed on wefew.net if your purchase is made outside of wefew.net.
  7. You are not permitted to email other Buyers or users of wefew.net in an open or completed transaction to warn them away from a Seller or item.

    8. PAYMENT PROCESS

  8. When Buyers proceed to checkout they will be linked to PayPal to process payment. The Buyer agrees to abide by the terms of use of PayPal at http://www.paypal.com.. After payment is confirmed via PayPal, an e-mail will be sent to you confirming payment. The xe.com currency conversion function on the website is just a guideline – all currency conversion rates are handled by paypal

    9. DELIVERY PROCESS

  9. After you have made payment using Paypal, an email will be sent to the Seller alerting that an order has been placed and will include payment confirmation and delivery information. Sellers will then package and ship the item directly to you and alert you that the item has been shipped.

    10. COMMUNICATION WITH THE SELLER

  10. You are not permitted to email or contact the Seller directly. If the Seller initiates any contact outside of wefew.net, you are to notify us immediately at admin@wefew.net.
  11. You are encouraged to communicate with the Seller via a ‘contact this designer’ link or through the ‘send a query’ link on the site. The link will provide an open text form for you to complete and submit. An email will then be sent to you that you have received a message from the Seller and to log-in to respond. Your response to the Seller shall be made through wefew.net. Upon receipt of your response, wefew.net will send an email to the Seller or Sellers letting them know that you have responded and they will also need to log-in to respond. You can commission custom items in a similar way but with the addition of a price field. Once the item requirements and specifications are agreed upon, the Seller will complete the price field and a communication to you will ask you to accept or decline. If accepted, the item will appear in your shopping cart and the payment process will proceed accordingly.

    12. NON-INVOLVEMENT OF WEFEW.NET IN TRANSACTIONS

  12. You understand that wefew.net has been appointed by the Seller only as an agent for collection of payment and has no involvement in the delivery process between you and the Seller. You agree that after payment is made via Paypal, wefew.net shall be at liberty to release the payment received to the Seller with the right to retain any part of the said payment as may be agreed between wefew.net and the Seller. Any monies retained by wefew.net from the Buyer’s payment shall remain the property of wefew.net and shall be non-refundable to the Buyer or any person(s) claiming through the Buyer. In the event of any dispute between Buyer and Seller, the Buyer’s only recourse is against the Seller.

    13. ASSISTANCE

  13. If you have any problem with a transaction or the use of wefew.net, please contact us for assistance at admin@wefew.net.

    14. DISCUSSION FORUM

  14. A discussion forum will be available for Buyers and Sellers to communicate. Your use of the discussion forum will be subject to all the restrictions applicable to you as “Buyer” in this User Agreement.

C. ADDITIONAL SPECIAL TERMS AND CONDITIONS OF USE (APPLICABLE TO SELLERS)

SELLERS

  1. “Seller” or “Sellers” refer to any user of wefew.net who uses or used the services on wefew.net to display, promote, offer for sale and sell products.

    2. HOW TO USE SERVICE

  2. To use the services at wefew.net, you shall register as a User and apply for membership as a Seller with wefew.net. wefew.net does not allow the creation of accounts by anyone under the age of 18.
  3. Users who wish to sell their products shall register as a User and then apply for membership as a Seller. As part of the application process product images and an application completed by the user will be reviewed by a jury of industry leaders appointed by and at the sole discretion of wefew.net. The jury will review applications assessing them for impact, originality, innovation, quality aesthetics and marketability. Subsequent applications will be reviewed by existing members of wefew.net via the WeCurate programme. Five randomly selected members will assess the applications against the same criteria used by the original jury. If the total score from all reviewers is above 60%, applicants will be invited to become a member Sellers of wefew.net and can begin selling on the site. If not, their account will remain a User account.
  4. wefew.net reserves the right, in its sole and absolute discretion to determine within which (product) category your product(s) shall appear under. wefew.net further reserves the right to re-classify such placement in its sole and absolute discretion.
  5. You will define or receive a password and account designation upon completing wefew.net's registration process (“the Service”). You are responsible for maintaining the confidentiality of the password and account and for restricting access to your computer. You agree to be fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify wefew.net of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. wefew.net cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 5.

    6. SELLER’S OBLIGATIONS

  6. In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or wefew.net has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, wefew.net has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
  7. You represent and warrant to wefew.net that:
    1. You own the products posted for sale on wefew.net, you are free to sell such products, including sales on or through, or facilitated on or through a global computer network
    2. You are legally capable of selling such products and entering into and performing an agreement for the sale of such products;
    3. Any description of the products posted on wefew.net is true and accurate, and is not misleading or otherwise fraudulent;
    4. The products posted on wefew.net, and as delivered to the Buyer, are and will be free of material defect or damage, and if they are not, you will at your own expense immediately remedy the situation to the reasonable satisfaction of the Buyer;
    5. The products posted on wefew.net are safe, are not illegal or dangerous, and do not infringe upon anybody's rights of any nature (for example, registered design trademark, copyright or patent); and
    6. You will immediately handle query sent to you by admin@wefew.net in respect of any question or complaint raised by the Buyer through admin@wefew.net.
  8. wefew.net claims no intellectual property rights over the material you provide to wefew.net. Your profile and materials uploaded remain yours. You can remove your profile at any time by contacting admin@wefew.net with the request to terminate your account. This will also remove any private images you have stored in the system. However, by uploading images and item description content to wefew.net, you agree to allow wefew.net to display and store them and you agree to allow other users of wefew.net to view them.

    9. SALE PROCESS

  9. Buyers shall purchase an item listed by you by using the “Buy” function on wefew.net. When Buyers proceed to checkout, they will be linked to PayPal to process payment. All payments on wefew.net are made through PayPal. After payment is confirmed via PayPal, an e-mail will be sent to the Buyer confirming payment. An email will also be sent to you alerting that an order has been placed and will include payment confirmation and delivery information. You will then package and ship the item directly to the Buyer and alert the Buyer that the item has been shipped. You understand that wefew.net has no involvement in the transaction between you and the Buyer. You will be responsible to promptly and properly deliver the purchased products in accordance with the terms of the purchase.
  10. Buyers can commission custom items from you if you activate this feature on your account. Once the item requirements and specifications are agreed upon, via the query form you will complete the price field and send the communication to the Buyer to ask them to accept or decline. If accepted, the item will appear in the shopping cart and the payment process will proceed accordingly.

    11. DELIVERY PROCESS

  11. While we do not require you to provide a tracking number when shipping orders to the Buyer, we strongly advise you to do so. By providing a tracking number, in the event a Buyer files a complaint that they never received their item or items, you will be able to verify the arrival of the shipment. If you fail to provide a tracking number, there would be no way to verify the arrival of the shipping. In that event, you will be required to either refund their money or reship the item or items.

    12. PAYMENT OF FEES AND COMMISSION

  12. Your use of the services on wefew.net shall be subject to your payment of a fee of 15% of the sale of an item to wefew.net (“sales commission”). The sales commission is non-refundable in any case.
  13. Any unpaid amount due and payable by you to wefew.net shall remain a debt due to wefew.net and shall remain so until it is paid by you.

  14. PAYMENTS RECEIVED FROM BUYERS

    1. You authorize wefew.net to collect payments from Buyers on your behalf and to pay to itself the sales commission by deducting from the amount(s) received from the Buyer. On the 15th day of the month following confirmation of delivery and receipt of payment from the Buyer, wefew.net shall pay to the Seller the amount received from the Buyer less the sales commission into the Sellers’s PayPal account. You shall open a Paypal account and be subject to all terms and condition as may be imposed by Paypal from time to time. Any charges or fees imposed by Paypal to process the payment or to maintain the Paypal account shall be borne by the Seller.. Following the payment, wefew.net shall send to you a statement for the amount paid to you. If you need any clarification of the statement, please contact us at admin@wefew.net within 7 days of receipt of the statement. If no objection to any statement is made to us after 7 days of receipt of the statement, the statement will be deemed to be correct and accepted by you.
    2. You agree that the sales commission paid to wefew.net by way of deduction from the Buyer’s payment for the purchase of an item from you shall remain the property of wefew.net and is non-refundable to the Buyer or any person(s) claiming through the Buyer.

    LIMITATION OF LIABILITY

  15. In no event shall we, our subsidiaries, officers, directors, employees, agents, service providers or our business associates be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with the use of our site, our services or this User Agreement (however arising, including any negligence). Our liability, and the liability of our subsidiaries, officers, directors, employees, agents, service providers or our business associates, to you or any third parties in any circumstance is limited to the greater of (a) the amount of fees you pay to us in the 12 months prior to the action giving rise to liability, or (b) $100.
  16. wefew.net cannot guarantee site sales to its members. wefew.net shall take all reasonable action to ensure that wefew.net venue will be professionally, ethically, and diligently promoted.

    17. PROHIBITED ACTIONS

  17. You are not permitted to email or contact any Buyer directly outside of wefew.net. If any Buyer initiates any contact with you outside of wefew.net, you are to notify us immediately at admin@wefew.net.
  18. You are not permitted to email other Buyers or users of wefew.net in an open or completed transaction to warn them away from any Seller or item listed on wefew.net. If you have a problem with a transaction, please use the link admin@wefew.net.
  19. Offers to buy or sell items listed on wefew.net (“listed item”) outside of the wefew.net are not permitted. Offers of this nature are a potential fraud risk for both Buyers and Sellers and circumvent wefew.net’s fees. Any breach of this term shall entitle wefew.net immediately and wefew.net shall be entitled to charge you a commission of 15% of the sale price of any item listed on wefew.net if your sale is made outside of wefew.net. The prohibited actions include but are not limited to:
    1. Using member contact information obtained from wefew.net or using wefew.net to offer to sell any listed item outside of wefew.net.
    2. Ending a listing early or canceling a listing to sell to a Buyer who became aware of the item through wefew.net.
    3. Offering to sell duplicates of listed items to Buyers without going through wefew.net.
    4. Sending unsolicited (without prior permission) commercial email offers to Buyers for the same or similar products that they have purchased through wefew.net in the past.

    FORUMS

  20. Buyers will be encouraged to communicate with you via a ‘contact this designer’ link on the site. The link will provide an open text form for Buyers to complete and submit. An email will then be sent to you that you have received a message and to log-in to respond. Your response to the Buyer shall be made through wefew.net. Upon receipt of your response, wefew.net will send an email to the Buyer or Buyers letting them know that you have responded and they will also need to log-in to respond.
  21. A discussion forum will be available for Buyers and Sellers to communicate. Your use of the discussion forum will be subject to all the restrictions applicable to you as “Seller” in this User Agreement.

    22. PRIVACY POLICY

  22. You must abide by the privacy policy set in place for this web site as a whole. Any and all Buyer information collected on this web site will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned. Any information provided by the customer will be held with the utmost care and will not be used in ways that the customer has not consented to.

    23. NO AGENCY

  23. You acknowledge and agree that you and wefew.net independent contractors, and no agency (other than for the collection of payment from the Buyer), partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

    24. INDEMNITY

  24. You agree to indemnify and hold wefew.net, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through wefew.net, your use of wefew.net, your connection to wefew.net, your violation of any of the terms of this User Agreement or your violation of any rights of any user of wefew.net.
  25. You understand that because wefew.net cannot and does not attempt to verify the information you post on wefew.net or provide to any prospective Buyer concerning your products, or monitor your compliance with the terms of this agreement, and because wefew.net is not involved in the sales transaction or the delivery of the products purchased, wefew.net cannot and will not accept any liability that results from the display, offering for sale, sale or delivery of your products through wefew.net. Therefore, you agree to defend, indemnify and hold harmless wefew.net, its officers, directors, employees, affiliates, agents, attorneys, and any other related entity, from and against any and all demands, claims, actions, causes of action, liabilities, suits, proceedings, investigations or inquiries, or any settlement thereto, and all related expenses, including, but not limited, to all litigation expenses (including reasonable attorneys' fees and court costs) and settlement amounts, as well as all special and consequential damages and damage to wefew.net, wefew.net's goodwill and reputation that arises from or in connection with the display, sale, transfer or use of your products displayed upon or acquired through wefew.net.

    26. NOTICES

  26. Except as explicitly stated otherwise, any notices from you to wefew.net shall be given by postal mail to Cherry Collective Online Pte Ltd at 36 Duxton Hill; 4th Storey; Singapore 089614 and any notices from wefew.net to you shall be given to your either by postal mail or email to the email address you provide to wefew.net in the registration process. Notice by email shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. In the case where wefew.net give you notice by certified mail, postage prepaid and return receipt requested, to the address provided by you to wefew.net during the registration process, notice shall be deemed given 3 days after the date of mailing.
